With regard to the Duke rape case, it has been suggested that in the past rape convictions have been obtained without DNA evidence. However it should be pointed out that some of these convictions were obtained before DNA emerged as an investigative tool. Now occasions where DNA capability is there and no DNA is found should have greater exculpatory weight or value than in previous cases where there was no ability to detect DNA evidence.
