With regard to the Duke rape case, it has been suggested that in the past rape convictions have been obtained without DNA evidence. However it should be pointed out that some of these convictions were obtained before DNA emerged as an investigative tool. Now occasions where DNA capability is there and no DNA is found should have greater exculpatory weight or value than in previous cases where there was no ability to detect DNA evidence.

It is possible that a similar theory to the one related in the crime/fiction book 'The Glove' by lem Yedowicz could be behind the hints of 'other killers' in the OJ Simpson case first by lawyer Shapiro of the defence team, and later when Lee Bailey declared a new approach with other suspects in the Simpson appeal.
It seemed that all this entailed a closer look at Mark Fuhrman's testimony.
